Many business owners believe that adding specific numerical ranges to a patent can exclude competitors. However, the Intellectual Property High Court of Japan ruled on April 23, 2026, in Case No. 10069/2025, that merely piecing together existing specifications and numerical values rarely passes the test of inventive step. In Patent No. 6590596, the plaintiff argued that the specific ratio between the packaging film's basis weight and the product mass was unique. Yet, the court found that increasing paper roll length and adjusting packaging thickness based on prior art were mere design choices within common technical knowledge, thus upholding the patent's invalidation. While businesses outside the packaging industry remain unaffected, those involved in packaging design should be wary of the invalidation risks of such "jigsaw" patents. Much like in financial investing, where simply reallocating existing portfolios does not yield excess returns, a patent cannot gain true legal protection without substantive technological breakthroughs.
